SMS Terms
These SMS Terms govern your participation in the RubyDane text messaging program, operated by Infrared Project Inc. ("Infrared Project," "we," "us," or "our"). By provisioning a phone number through the Infrared Project app and opting in to receive text messages from your agent, you agree to these SMS Terms and to our SMS Privacy Policy.
1. Program description
RubyDane is a personal AI agent that keeps you informed about your own business. When you provision a phone number through the Infrared Project app, that number is used for messages between you and your agent. Message types include:
- Alerts when a new lead or inquiry arrives
- Appointment and booking confirmations and reminders
- Notifications that drafted replies are waiting for your review or approval
- Status updates and summaries about activity in your account
- Replies to messages you send your agent
You are the only recipient. This program sends messages to you, the account holder, on a number you provision and control. It is not used to message your customers, your contacts, or any third party.
2. Eligibility and opt-in
- You must be at least 18 years old to participate in this program.
- You opt in during number setup in the Infrared Project app by entering your mobile number and affirmatively checking a consent box that is unchecked by default. No messages are sent before that box is checked.
- You may also opt in by texting your provisioned agent number first, which triggers a confirmation message before any further messages are sent.
- Consent to receive text messages is never required as a condition of purchasing anything or of using other parts of the app.
3. How opt-in works, step by step
Number setup happens inside the Infrared Project app, which requires an account. The screens below reproduce that flow exactly as an account holder sees it, so the consent language and mechanics can be reviewed without an account.

After signing in, you provision a number for your agent and enter the mobile number where you want updates sent. The consent box is unchecked by default and the disclosures are shown in full before you agree to anything.

4. Message frequency and rates
- Message frequency varies based on activity in your account. Expect messages tied to real events, such as a lead arriving, an appointment confirming, or a draft needing approval, rather than a fixed recurring schedule.
- Message and data rates may apply. Standard messaging and data charges from your wireless carrier apply to messages sent and received through this program.
5. Opting out and getting help
- Text STOP at any time to cancel. You will receive one final message confirming the opt-out, and no further messages will be sent to that number. CANCEL, END, QUIT, UNSUBSCRIBE, REVOKE, OPTOUT, and STOPALL work the same way.
- Text HELP or INFO for assistance, or contact us using the details at the bottom of this page.
- You may opt back in at any time by texting START or by re-enabling messaging in your account settings.
- Opting out of text messages does not close your account or stop other parts of the app from working.
6. Carrier disclosures
Carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission from your network operator. Not all carriers or devices are supported. Participating carriers include the major U.S. wireless carriers.
7. Data use and no sharing
We do not share, sell, or rent your mobile phone number or your SMS opt-in and consent data to any third party or affiliate for their own marketing or promotional purposes. Text messaging originator opt-in data and consent are never shared with third parties for any purpose other than operating this messaging service. Full details are in our SMS Privacy Policy.
8. Your responsibilities
- Keep your mobile number current in your account settings. If you change or give up a number, update it so messages about your business are not sent to someone else.
- The number you provision is for communication between you and your agent. Using it to message third parties who have not consented is a violation of our Terms of Use and may result in suspension.
9. Disclaimers and liability
The SMS program is provided "as is." Messages drafted or summarized by an AI agent can contain errors and should be reviewed before being relied on for anything that matters. To the maximum extent permitted by law, Infrared Project Inc. will not be liable for indirect, incidental, or consequential damages arising from your participation in this program, including message delays or failures caused by carriers or by factors outside our control.
10. Changes to these Terms
We may update these SMS Terms from time to time. We will update the "Last updated" date above. Continued participation in the program after a change takes effect is acceptance of the updated terms.
11. Governing law
These SMS Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.
