SMS Privacy Policy
This SMS Privacy Policy explains how the RubyDane text messaging program, operated by Infrared Project Inc. ("Infrared Project," "we," "us," or "our"), collects, uses, and protects information connected to text messages sent between you and your personal AI agent. It supplements, and does not replace, our full Privacy Policy. If anything here conflicts with that policy on an SMS-specific matter, this document controls.
1. About the program
RubyDane is a personal AI agent for people running a business. When you sign up for the Infrared Project app, you can provision a phone number through the platform. Your agent uses that number to text you about your own business, covering new leads, appointment confirmations, reminders, and drafts waiting for your review, and to respond when you text it.
You are both the account holder and the recipient. Messages in this program go to you, on a number you provision and control. No third-party contact list is involved, and we do not collect phone numbers belonging to anyone but you.
2. Information we collect
- Your mobile phone number, which you enter during number setup in the app, so your agent knows where to reach you.
- The number you provision through the platform, which is assigned to your account and used for your agent's messages.
- Message content and metadata: the text of messages sent and received between you and your agent, timestamps, and delivery status, needed to operate the conversation.
- Consent and opt-out records: when and how you opted in, and any STOP or HELP replies, so we can honor them reliably.
3. How we use this information
We use the information above only to:
- Send you the messages your agent is configured to send, and deliver your replies to it;
- Track and honor consent, opt-outs (STOP), and help requests (HELP);
- Maintain delivery logs required for carrier compliance and troubleshooting; and
- Improve the reliability and deliverability of the messaging service.
We do not use your phone number or message content to serve ads, build advertising profiles, or train general-purpose AI models.
4. No sharing of mobile information
We do not share, sell, rent, or otherwise disclose mobile phone numbers or SMS opt-in and consent data to any third party or affiliate for their own marketing or promotional purposes. No exceptions.
Text messaging originator opt-in data and consent are never shared with third parties for any purpose other than providing the SMS service itself. The only parties that ever process this data are:
- Our messaging delivery provider, acting strictly as a processor to transmit messages;
- The service providers that host our infrastructure, bound by contract to use the data only to keep the platform running.
5. Consent, frequency, and rates
- How you opt in. During number setup in the app, you enter your mobile number and affirmatively check a consent box that is unchecked by default. You may also opt in by texting your agent number first, which triggers a confirmation before any further messages are sent. Consent is never a condition of purchase or of using other parts of the app.
- Message frequency varies based on activity in your account, since messages are tied to real events rather than a fixed schedule.
- Message and data rates may apply. Standard charges from your mobile carrier apply to messages sent and received.
6. Opting out and getting help
- Reply STOP at any time to opt out. You will receive one confirmation message, and no further messages will be sent to that number.
- Reply HELP for assistance, or contact us using the details at the bottom of this page.
- Carriers are not liable for delayed or undelivered messages. Not all carriers or devices may be supported.
7. Data security and retention
Message data is encrypted in transit using TLS 1.2 or better and encrypted at rest. Internal access is limited to what is needed to operate the service and is logged. We retain message and consent records only as long as needed to operate the program, satisfy carrier and legal requirements, and honor opt-outs, after which they are deleted or anonymized. Opt-out records are kept longer where carrier or legal requirements demand it, precisely so that an opt-out is never lost.
8. Your rights and choices
Depending on where you live, you may have the right to access, correct, export, or delete the personal information we hold about you, and to withdraw consent at any time. To exercise any of these, contact us using the details below. We will respond within the time the applicable law requires.
9. Children's privacy
This program is intended for individuals 18 years of age or older. We do not knowingly collect information from children through this program.
10. Changes to this Policy
We may update this SMS Privacy Policy from time to time to reflect changes in our practices or legal requirements. We will update the "Last updated" date above. Material changes will be communicated where the law requires it.
